Welcome to CalmSeaShore ("us," "we," or "our"). These Terms & Conditions ("Terms") dictate your usage of our yacht rental services and our website located at calmseashore.sbs (the "Service") managed by CalmSeaShore.

By securing a charter or using our Service, you consent to these Terms. Should you not agree with any part of these terms, you should refrain from using the Service.

2. Service Overview

CalmSeaShore offers an array of upscale yacht charter services, which includes but is not confined to:

• Day-long yacht hires
• Evening boat rides
• Company retreats
• Exclusive events
• Lengthy charters that span multiple days

Our services are provided based on their availability and certain weather conditions. We retain the authority to adjust or terminate services without notice.

3. Booking and Reservations

3.1 Booking Process

For a successful yacht charter reservation, you are required to:

• Be a minimum of 18 years old
• Submit valid and complete details
• Make payment for the specified deposit as indicated in your reservation confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking is validated only after the payment is received and our official acknowledgment is issued. We reserve the discretion to decline service to any individual.

3.3 Availability

Charter services are dependent upon the availability of vessels and favorable weather conditions. We intend to fit your preferred schedule to the best of our abilities.

4. Payment Terms

4.1 Pricing

All fees are presented in $ and are inclusive of all applicable taxes unless stated otherwise. The prices are liable to modifications without prior notice.

4.2 Payment Schedule

• Initial Deposit: 50% of the complete cost of the charter, required at the time of reservation
• Final Payment: To be made 48 hours before the departure of the charter
• Extra charges (if applicable): To be settled upon the charter's conclusion

4.3 Payment Methods

We accept most credit cards, perform bank wire transfers, and accept certified cheques. Payment processing is conducted using encrypted, secure systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• 72 hours or more prior to departure: Full refund less any transaction fees
• Between 24 to 72 hours before departure: Refund of 50%
• Within 24 hours before departure: No refund provided

5.2 Weather Cancellations

In the event weather conditions are not safe as determined by our captain, options will include:

• Rescheduling of your charter without extra costs to an upcoming available date
• A complete refund if the charter cannot be rescheduled

5.3 Mechanical Issues

Should there be any mechanical issues with the designated vessel, we will endeavor to offer an acceptable replacement. If we're unable to provide an alternative, you will receive a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All individuals on board are expected to:

• Heed all instructions from the crew
• Utilize the safety gear as directed
• Inform of any medical conditions that might impact their safety
• Stay within permitted areas on the vessel

6.2 Prohibited Items

Certain items are not allowed on board:

• Items made of glass
• Banned substances
• Weapons or firearms
• Excessive amounts of non-alcoholic drinks
• Pets (subject to prior approval)

6.3 Conduct

All passengers are obliged to behave respectfully. Behaviour that endangers safety or disrupts the experience for others may lead to the premature termination of a charter without a refund.

7. Liability and Insurance

7.1 Our Liability

Our accountability is limited to the paid amount for your charter. We are not accountable for:

• Injuries that occur due to your own negligence
• The loss or damage of personal possessions
• Indirect, consequential, or punitive losses
• Delays caused by weather or other factors outside our control

7.2 Insurance Coverage

We maintain inclusive marine insurance that covers our vessels and our operations. You are responsible for securing your own travel and personal insurance.

7.3 Assumption of Risk

By engaging in our yacht hire services, you recognize that such activities come with inherent risks which you acknowledge and agree to bear responsibility for your own safety and security.

8. Modifications and Itinerary Changes

We hold the right to alter itineraries, pathways, or schedules due to weather concerns, safety needs, or other operational prerequisites. We will strive to offer similar alternatives when possible.

9. Force Majeure

We shall not be held responsible for interruptions, cancellations, or changes caused by events out of our control, such as:

• Extreme weather conditions
• Natural phenomena
• Legal mandates
• Closures of ports
• Technical breakdowns

10. Privacy and Data Protection

Your private data is processed according to our Privacy Policy. You consent to the collection and usage of your information as outlined in this policy.

11. Intellectual Property

The entire content on our website, such as text, images, graphics, and logos are protected by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivatives is prohibited without explicit written consent from us.
